Welcome to Kanut Studio (“we,” “us,” or “our”). These Terms and Conditions govern your access to and use of our website (http://kanutstudio.com) (the “Site”) and our voice-over recording services (collectively, the “Services”). By accessing or using our Site and Services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or Services.

1. Services

We provide custom voice-over recording services, including but not limited to narration, commercials, audiobooks, and other audio productions (the “Services”). Details of the Services, including pricing and turnaround times, are provided on our Site. We reserve the right to modify or discontinue our Services at any time without notice.

2. User Responsibilities

By accessing our Site and using our Services, you represent and warrant that:

• You are at least 18 years old or have the permission of a legal guardian.
• You will provide accurate and complete information when placing an order.
• You will not use our Services for any illegal or unauthorized purpose.
• You will respect the intellectual property rights associated with the Services provided by us.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3. Orders and Payment

A. Order Process
To place an order, submit your project details via our Site or to other email address info@kanutstudio.com. Each order is considered an offer to purchase our Services, subject to our acceptance. We reserve the right to accept or decline any order for any reason.

B. Pricing and Payment
Prices for our Services are listed on our Site or communicated directly via email. All payments must be made in advance, and your order will not be processed until payment is received. We accept payments via Debit/Credit cards, and PayPal. We reserve the right to adjust prices and availability at any time.

C. Refunds
Our refund and cancellation policy is outlined in our Refund and Returns Policy.

4. Revisions

We offer a maximum of two (2) free revisions per project to address minor changes such as tone, pacing, or pronunciation issues, as outlined in the project brief. Additional revisions may incur extra fees, which will be communicated in advance. Revisions are limited to adjustments based on the original script and instructions. Any significant script or direction changes will require a new order and payment.

5. Intellectual Property Rights

A. Ownership of Recordings
Upon full payment, we grant you an exclusive, license to use the final voice-over recording for the agreed-upon purpose. Ownership of the voice recording does not remain with Kanut Studio unless explicitly transferred in writing after payment.

B. Client Materials
You represent and warrant that you own or have the right to use all scripts, texts, and other materials you submit to us for use in creating your recording. You grant us a limited license to use these materials for the purpose of providing the Services.

C. Copyright Infringement
If we believe any submitted materials infringe on third-party intellectual property rights, we reserve the right to refuse service or cancel the order without a refund.

6. Confidentiality

We respect the confidentiality of all materials provided by our clients. Any information or materials provided by you will only be used for the purpose of fulfilling your order and will not be shared with third parties without your consent, except as required by law.

7. Limitation of Liability

To the fullest extent permitted by law, Kanut Studio shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services or any issues related to your order. Our maximum liability to you, for any reason, is limited to the amount paid for the Services.

8. Disclaimer of Warranties

Our Services are provided “as is” and “as available,” without any warranties or guarantees of any kind, express or implied. We do not guarantee that the Services will meet your expectations or that the Site will be uninterrupted, error-free, or secure.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kanut Studio and its employees, contractors, and affiliates from any claims, damages, liabilities, and expenses arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

We reserve the right to terminate or suspend your access to our Site or Services at our discretion, without notice, for conduct we believe violates these Terms or is otherwise harmful to our business or users.

11. Governing Law

These Terms and any disputes arising from your use of our Site and Services shall be governed by the laws of Medellin, Colombia without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Medellin, Colombia for any legal action arising out of these Terms.
